Terms of Service

Participation in the Atlantis Surf Hostel Gran Canaria organized activities (surf lessonssurfariPersonal surf coaching), requires the full acceptance of these "General Terms and Conditions". If the activities are carried out by third parties on behalf of Atlantis Surfhostel, their own general terms and conditions may apply.

1. PAYMENT TERMS, SECURITY

Upon confirmation of the booking by Atlantis Surfhostel, 15% of the booking price must be transferred immediately to the following account:

The remaining amount, 85% of the booking price, must be paid in cash to Atlantis Surfhostel on the first day of your holiday at the latest. Better beforehand via the booking system.

2. CONCLUSION OF A TRAVEL AGREEMENT

Registration by the participant is binding. It also applies to all participants listed in the registration, for whose contractual obligations the applicant is responsible as for his own obligations. The contract is concluded with the confirmation by Atlantis Surfhostel.

3. MODIFICATIONS TO THE BENEFITS

Atlantis Surfhostel expressly reserves the right to make changes to the service description for objectively justified, significant and unforeseeable reasons before the contract is concluded.

4. WITHDRAWAL BY THE CUSTOMER

The customer can withdraw from the trip at any time before the start of the trip. The customer must declare withdrawal in writing or by telex. The deregistration is effective from the day it is received by Atlantis Surfhostel. If the customer withdraws from the travel contract or does not start the trip, Atlantis Surfhostel can demand compensation for the travel arrangements made and for all other expenses in this connection. When calculating the compensation, usually saved expenses and usually relevant other use of the travel services are to be taken into account. Atlantis Surfhostel can calculate this claim for compensation as a percentage of the travel price as a percentage of the travel price according to the following structure, based on the proximity of the time of withdrawal to the contractually agreed start of travel:

  • up to 72 hours before the start of the booking, the client may cancel free of charge

  • After those 72 hours have passed, 100% of the booking will be charged

Once the client has arrived, no refunds will be allowed under any circumstances for any of the nights of the reservation.

There is no entitlement to rebooking. Until the start of the journey, the traveler can demand that a third party take over the rights and obligations arising from his travel contract. Atlantis Surfhostel can object to the entry of the third party for important reasons. If a third party enters into the contract, the entering third party and the traveler are jointly and severally liable to Atlantis Surfhostel for the travel price and the additional costs incurred through the entry of the third party. It is the customer's responsibility to prove that no costs or significantly lower costs were incurred in connection with the cancellation or non-appearance of the trip than the costs stated by Atlantis Surfhostel in the flat rate.

5. WITHDRAWAL AND TERMINATION BY ATLANTIS SURFHOSTEL

Atlantis Surfhostel can withdraw from the travel contract before the start of the trip or terminate the travel contract after the start of the trip in the following cases: Without observing a deadline, if the traveler disrupts the execution of the trip despite a warning from Atlantis Surfhostel or its representatives (e.g. does not follow the instructions of the course instructor) or if he behaves in breach of contract to such an extent that the immediate cancellation of the contract is justified. If Atlantis Surfhostel cancels, the claim to the travel price remains. However, Atlantis Surfhostel must allow the value of the expenses saved as well as those benefits that have been obtained from other uses of the unused services, including the amounts credited by other service providers, to be credited.

6. TERMINATION OF THE CONTRACT DUE TO EXTRAORDINARY CIRCUMSTANCES

If the trip is made significantly more difficult, endangered or impaired when the contract is concluded due to unforeseeable force majeure, both Atlantis Surfhostel and the traveler can terminate the contract. If the contract is terminated, Atlantis Surfhostel can demand appropriate compensation for the travel services already rendered or for the travel services still to be rendered at the end of the trip.

7. OBLIGATION TO COOPERATE

In the event of any disruptions to service, the traveler is obliged to do everything that is reasonable for him to help remedy the disruption and to minimize any damage that may occur. In particular, the traveler is obliged to report his complaints immediately on site.

8. DISCLAIMER OF CLAIMS AND STATUTE OF LIMITATIONS

Claims for non-contractual provision of the trip must be asserted by the traveler within one month of the contractually agreed end of the trip to the tour operator. Claims of the traveler become statute-barred within one year. If the traveler has asserted such claims, the statute of limitations is suspended until the day on which Atlantis Surfhostel rejects the claims.

9. PASSPORT, VISA AND HEALTH REGULATIONS, INSURANCE

The traveler is responsible for compliance with all regulations important for the implementation of the trip. Travelers without German citizenship are obliged to obtain information about passport, visa and health regulations from the responsible consulate. Should the entry regulations of individual countries not be observed by the traveler, or should a visa not be issued in time through the fault of the traveller, so that the traveler is therefore prevented from traveling, Atlantis Surfhostel can charge the traveler with corresponding cancellation fees.

10. SIDE AGREEMENTS, INVALIDITY OF INDIVIDUAL PROVISIONS

Subsidiary agreements and other assurances are only effective if they are confirmed in writing by Atlantis Surfhostel. The invalidity of individual provisions of the travel contract does not result in the invalidity of the entire travel contract.
